LEXINGTON, Ky. — The Lexington Board of Adjustment heard four variance appeals and eight conditional use requests at its meeting on September 14, considering applications ranging from residential driveway modifications to church sanctuary expansions and short-term rental permits across multiple council districts.
The board, which grants variances and conditional use permits under city zoning ordinances, tackled setback reduction requests that drew mixed recommendations from planning staff. Nicholas Wolter's request to eliminate a five-foot front yard setback at 716 Harrison Trace to construct a driveway in an Expansion Area Residential zone drew a staff recommendation for disapproval, with planners arguing he had not shown sufficient hardship and that on-street parking is available. Matthew Gene Lawson's similar request at 232 Warnock Street, however, earned staff approval, with planners noting the property's grade drop limits driveway options and that adjoining homes feature comparable nonconforming driveways.
Kelley Navarro's application to reduce a side yard setback from 25 feet to 9 feet, 5 inches for an addition to an existing structure at 3812 Royster Road in Council District 12 also received a staff recommendation for approval, with planners citing the lot's narrow shape as a unique constraint. The board recommended disapproval of a variance request from Embry Property Management LLC to increase an accessory building's allowable size by 120 percent and its maximum height in a Single Family Residential zone, citing insufficient special circumstances and evidence the work was conducted without proper permitting.
Two religious organizations sought conditional use permits to expand their operations. Berea Christian Church received a staff recommendation to approve an amendment to its existing conditional use permit to construct a sanctuary and parking lot, though staff recommended a lesser variance reducing the front yard setback from 50 feet to 30 feet rather than the requested 15 feet to keep the structure outside the floodplain. Olive Branch Church's application to occupy a structure for religious assembly in a Wholesale and Warehouse Business zone at 2380 Fortune Drive also drew staff approval.
Three applications for unhosted short-term rentals received staff approval recommendations, including TNT Kentucky Estates LLC's request for 3182 Aqueduct Drive in Council District 8. Planners noted the property has adequate parking, no short-term rentals within the required buffer zone, and no compliance issues with the applicant's previous rentals.
