LEXINGTON, Ky. — The Board of Adjustment is scheduled to consider four variance appeals and eight conditional use requests on Saturday at 1:30 p.m. in the Council Chambers at 200 East Main Street, according to the board's meeting agenda.

The board, which grants variances and conditional use permits under city zoning ordinances, will hear cases ranging from residential driveway setbacks to church sanctuary expansions and short-term rental applications across multiple council districts.

Among the variance requests, Nicholas Wolter seeks to eliminate the required five-foot front yard setback to construct a driveway at 716 Harrison Trace in an Expansion Area Residential zone, but planning staff recommends disapproval. Staff argues the applicant has not shown sufficient hardship and that on-street parking is available along Harrison Trace.

Matthew Gene Lawson's request to reduce a front yard setback from 20 feet to zero feet at 232 Warnock Street has earned staff support, with officials citing the property's natural grade drop that limits rear driveway extension. Kelley Navarro's application to reduce a side yard setback from 25 feet to 9 feet 5 inches for an addition at 3812 Royster Road also receives staff recommendation for approval.

A more contentious case involves Embry Property Management LLC's request to increase accessory building size from 731.5 square feet to 1,760 square feet at a property in the Infill and Redevelopment Area. Planning staff recommends disapproval, stating the applicant has not demonstrated unique circumstances and that the work was conducted without a permit.

Several conditional use permits appear on the docket. Berea Christian Church seeks to amend an existing permit for a place of religious assembly and construct a new sanctuary and parking lot, with staff recommending approval of a reduced setback variance from 50 feet to 30 feet instead of the requested 15 feet. Conditions include removal of parking from floodplain areas and installation of water quality elements.

Olive Branch Church seeks a conditional use permit to occupy an existing structure at 2380 Fortune Drive in a Wholesale and Warehouse Business zone, with staff supporting the request. Shiloh Baptist Church on East Fifth Street and Engman Avenue requests approval to establish a childcare center utilizing existing classroom space, subject to compliance with state regulations and provision of a fenced outdoor play area.

Short-term rental applications dominate the conditional use agenda. TNT Kentucky Estates LLC and Blama 2 LLC seek permits for un-hosted short-term rentals on Aqueduct Drive and Lakefront Drive respectively, with occupancy caps of four and six individuals. Jon Kevin Baker requests an un-hosted rental permit for 262 Albany Road, limited to six occupants. All three applications have earned staff approval.

Tiffany Kruger seeks a conditional use permit for a home-based physical therapy and health coaching business at 1104 Aldridge Way, with staff recommending approval. Southern Cookhouse & Bar requests approval to establish live entertainment and a variance to reduce the minimum distance from residential zones from 100 feet to 24 feet at 840 Hays Boulevard.
