
Lexington Board of Adjustment considers five zoning variance requests
LEXINGTON, Ky. — The Lexington-Fayette Urban County Government Board of Adjustment considered five zoning variance requests at its April 13 meeting at City Hall, with staff recommending approval for all five applications after finding they would not adversely affect public health, safety or welfare.
The board heard appeals for various property modifications, including setback reductions and parking area adjustments across residential, commercial and industrial zones throughout the city. According to the meeting agenda, the applications centered on dimensional variances that allow property owners to deviate from standard zoning ordinance requirements when unique circumstances affect their properties.
Eye 4 Group requested a variance to reduce the required setback for a free-standing sign from 10 feet to 3 feet at 1565 McGrathiana Parkway in the University Research Campus zone. The LFUCG Zoning Ordinance regulates how land in Fayette County is developed. Staff recommended approval, citing an eight to ten-foot change in elevation along the property's frontage as a unique circumstance justifying the variance.
Brennan Mullins sought approval for a rear yard setback reduction from 20 feet to 15 feet and a driveway width increase from 10 feet to 20 feet at 644 Chestnut Street in the Planned Neighborhood Residential zone. Staff recommended approval, noting the property's location within the Infill and Redevelopment Area, where the zoning ordinance specifically allows Board of Adjustment action to facilitate appropriate development in established neighborhoods.
Greg Brumagen requested a side street setback variance for accessory structures at 6970 Grimes Mill Road in an Agricultural Rural zone, seeking to reduce the requirement from 50 feet to 22 feet 8 inches. Staff recommended approval, noting the accessory structures could only feasibly be located in that area given the property's size, layout and topography.
The board also considered a variance for 1711 Lakewood Lane to reduce the required front yard setback from 40 feet to zero feet to modify a circular driveway in a Single Family Residential zone. Staff recommended approval, citing existing circular driveways and front yard parking areas already present on the subject property and surrounding properties.
A fifth application from William Wood requested variances to reduce vehicular use area buffers at 419 Chair Ave in the Light Industrial zone. Staff recommended approval of lesser variances that would provide adequate parking and pedestrian access while maintaining screening from adjacent properties.
The Board of Adjustment has the authority to grant dimensional variances under Kentucky law when property owners demonstrate unique circumstances that make strict zoning compliance impracticable. Applicants must show they are not attempting to circumvent zoning regulations and that variances would not harm public welfare.
